General Terms and conditions

1. Scope of application

These General Terms and Conditions apply to all services provided by Marcel Iofcea, hereinafter referred to as the “Provider”, to its customers. We only recognize deviating terms and conditions of the customer if this has been agreed in writing.

2. Range of services

The provider delivers professional presentations, training programs, and consulting services across various domains. The specific content and goals of these services are tailored individually in agreement with the customer.

Unless otherwise specified in the agreement (e.g., flat rates), travel and related expenses are charged as follows:

  • Railway: 1st class, including seat reservation.

  • Car: Mileage allowance of CHF 0.70 per km; rental car: upper middle class (or similar, depending on availability) plus fuel costs and full insurance coverage.

  • Airplane: Within Europe, Economy Class; outside Europe, Premium Economy or Business Class (including seat reservation and luggage).

  • Overnight stay: 4-star hotel or equivalent, including breakfast.

  • Expenses: Costs such as parking fees, taxis, local public transport, and other cash expenses related to the overnight stay, provided that speakers cannot reasonably be expected to arrive or depart on the day of the event during normal business hours (08:00-19:00) due to the timing of the lecture, or if the customer requests an extended stay.

After consultation, travel arrangements can also be made by the customer according to the above criteria.

3. Fees and terms of payment

The fees for the services provided are based on the agreed scope. Upon conclusion of the booking contract, 50% of the fee shall be due for payment immediately. The remaining 50% of the fee plus travel costs, expenses is due no later than 7 days after the workshop/lecture/seminar.

4. Cancellation conditions

If a booked appointment is canceled by the customer, the following cancellation fees are due. Cancellation of the appointment is possible with retention or charging as follows:

  • up to 3 months in advance: 25%

  • up to 1 month before: 50%

  • from 14 days before: 100%

5. Conclusion of contract

Contracts are concluded when the customer accepts the provider's offer. This can be done in writing, verbally or in electronic form.

6. Copyright and rights of use

The copyright for all materials provided as part of the service lies with the provider. The customer receives a non-exclusive, non-transferable right to use the materials within the agreed scope.

7. Liability

The provider's liability for damages resulting from the use of its services is limited to intent and gross negligence.

9. Final provisions

Should individual provisions of these GTC be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a provision that comes closest to the purpose of the original provision.

The place of jurisdiction is Zürich in Switzerland. Swiss law shall apply.
